在征诸传统法文化以论证构建刑事和解制度的正当性的研究中,存在一些对史料进行片面解读与过度诠释的情况:如未妥善解决中国古代的刑事与民事的区分问题,从而有混淆民事调解与刑事和解之嫌;又如过度诠释保辜制度,因为无论是从该制度见诸记载的最早文献出发,还是立足于作为传统法典代表的《唐律疏议》及吐鲁番出土文献所见的案例,皆无法推出保辜制度与刑事和解之间存在直接关联。
In the study of legitimating the construction of the criminal reconciliation system through the demonstration of traditional legal culture, there are some cases of one-sided interpretation and over interpretation of the historical data: if there is no proper resolution of the distinction between criminal and civil law in ancient China, Conciliation and criminal reconciliation; but also to over-interpret the system of guoku, either from the earliest documented records of the system or from the documents of the Tang Dynasty and Turpan unearthed from the representative of the traditional code Cases, are unable to introduce a direct correlation between the system of guokul and criminal reconciliation.
