法律史学的目的就是要研究一个社群中法律的进化。~①在以色列,这不是件容易完成的工作。以色列国家从某种意义上来说是独特的:它是一个新的国家,而犹太人的历史却很悠久。以色列国家短暂的历史充满了各种变化,而这是各种内在和外在冲突、移民浪潮和社会转型的结果。作为一个犹太人的民主国家,以色列国的特性,其在宗教问题和独特的立宪过程上的现状(status quo),只有置于其复杂的历史观之下才能得到理解。
The purpose of legal history is to study the evolution of law in a community. ~ ① In Israel, this is not an easy task. The Israeli state is unique in some ways: it is a new nation, and the Jews have a long history. The brief history of the nation of Israel is full of changes that are the result of various internal and external conflicts, the wave of immigration and social transformation. As a Jewish democracies, the character of the State of Israel, its status quo on religious issues and the unique constitutional process, can only be understood if placed under its complex historical perspective.
