目的探讨运用合同管理自愿无偿献血,弥补行业法律法规之不足,减少、避免自愿无偿献血纠纷,促进无偿献血健康持续发展。方法比较分析自愿无偿献血与赠与的构成要素及法律特征的相符性。结果自愿无偿献血的法律特征、概念、法律主体及主体的权利义务等与赠与基本符合。结论能弥补行业法律法规之不足,能减少、避免自愿无偿献血纠纷。
Objective To explore the use of contract management voluntary unpaid blood donation to make up for the lack of industry laws and regulations to reduce and avoid voluntary blood donation disputes and promote healthy and sustainable development of unpaid blood donation. Methods The comparative analysis of the componential elements and legal characteristics of voluntary non-remunerated blood donation and donation. As a result, the legal features, concepts, rights and obligations of the legal subject and the subject of voluntary blood donation were basically consistent with the gift. Conclusion can make up for the lack of industry laws and regulations, can reduce and avoid voluntary blood donation disputes.
