随着各种环境问题的日益突出 ,世界各国不得不在地区或国际层面上寻求比较有效的解决路径。多边环境协定可视为当前较为有效的国际环境机制。欧盟已在环境法的许多领域开展了立法活动 ,并有权实施缔约国大会或缔约国会议决议。多边环境协定下的附件调整程序会导致缔约国法律义务的实质性改变 ,甚至还会违背少数缔约国的意志。本文论述了多边环境协定的法律构架 ,探讨了缔约国大会或缔约国会议是否可视为国际组织的机构、多边环境协定下通过的具有约束力的决议与欧盟法的趋同以及多边环境协定与国际环境保护单边主义政策等问题。
With various kinds of environmental problems becoming more prominent, all countries in the world have to find a more effective solution to the problem at the regional or international level. Multilateral environmental agreements can be seen as more effective international environmental mechanisms. The EU has undertaken legislative activities in many areas of environmental law and has the power to implement the decisions of the Assembly of States Parties or the Conference of the Parties. Annex adjustment procedures under multilateral environmental agreements can result in substantial changes in the legal obligations of States parties and can even be contrary to the will of a few States parties. This paper discusses the legal framework of multilateral environmental agreements and discusses whether the Assembly of States Parties or the Meeting of States Parties can be regarded as an organ of an international organization, the convergence of binding resolutions adopted under multilateral environmental agreements and the EU law, multilateral environmental agreements and international environmental protection Unilateralism and other issues.
