我国台湾地区当前废除死刑的运动面临诸多困境,而香港、澳门废除死刑的道路与经验或可为台湾所借鉴。香港、澳门在大部分民众不赞成废除死刑的情况下,根据当时社会的发展需要,以社会精英主导的方式通过了废除死刑的法案,并且没有因此而引起严重犯罪率的上升,且经历多年已使社会大众适应了没有死刑的法治社会。台湾地区可借鉴香港、澳门废除死刑的经验,走向全面停止执行死刑,并理性面对死刑民意的舆论,科学斟酌死刑替代方案,以逐步实现全面废除死刑的最终目标。
The current campaign to abolish the death penalty in Taiwan in our country faces many difficulties. The path and experience of abolishing the death penalty in Hong Kong and Macao may be borrowed by Taiwan. Hong Kong and Maucao passed a bill to abolish the death penalty led by the social elites in accordance with the needs of the development of the community at the time when a majority of the people did not agree to abolish the death penalty. As a result, the incidence of serious crimes has not been raised for many years Adapt the general public to the rule of law without death penalty. Taiwan can learn from the experience of abolishing the death penalty in Hong Kong and Macao and move towards a complete cessation of the death penalty and rationally confront the public opinion about the death penalty and the people’s minds. Scientific consideration should be given to alternatives to the death penalty so as to gradually achieve the ultimate goal of abolishing the death penalty in its entirety.
