“WTO法是模范国际法”的论断首先意味着是在国际法的大语境中考虑WTO的制度体系,而不是将之作为完全独立的单元分析其长短优劣;其次意味着WTO在国际法的体系中具有引领和示范的效应。分析这一论断,如果以静态的、绝对的良法善治标准来看待和评价,则WTO并没有可能成为模范国际法。然而,如果以动态的、相对的视角来分析,则WTO确实在规则结构、体系发展、规范施行方面取得了相当的成就,优于国际法的绝大多数部门和领域。对于这一问题的论断,必须结合具体的语境和目的,就当代中国的国际经济法立场而言,宜缓称“WTO法是模范国际法”。

In terms of the standpoint of the current international economic law in contemporary China, it is appropriate to slow down “WTO law is a model international law.”
