英语和中文学界主流观点认为,隐私权的主张诞生于美国法律人沃伦和布兰代斯1890年12月15日发表于《哈佛法学评论》第4期的《隐私权》一文。近期,中山大学法学院张民安教授对此提出了质疑。他认为,法国才是在法律上最早承认隐私权的国家。本文结合相关法学和新闻传播学背景,对张教授的主要论据逐一辨析后认为,其结论理据不足,难以成立。
The mainstream view in the English and Chinese literature holds that the claim of privacy was born out of a “privacy” article published by the U.S. lawyer Warren and Brandeis on December 15, 1890 in Harvard Law Review No. 4. Recently, Professor Zhang Minan from Sun Yat-sen Law School raised the question. He believes that France is the first country legally recognized by privacy. Combining with the related jurisprudence and the background of journalism and communication, this dissertation analyzes Professor Zhang’s main arguments one by one and concludes that the conclusions are not sufficiently substantiated and difficult to set up.
