行政权作为对国家和社会事务进行控制、协调、指挥和管理的权力,其直接作用于国家事务的每一个方面,尤其是直接作用于社会成员。行政主体与行政相对人地位的不平等性,行政主体在行使行政权时存在的广泛自由裁量权,极易导致行政权的滥用。随着行政权的逐步膨胀,需要对其进行有效的制约,这需要行政机关在管理的过程中必须遵循一定的方式和步骤,接受法律的调整,不能随意而为,以保护行政相对方的合法权益,因此需要建立现代意义上的科学行政程序,提高行政效率,增进公共利益。
