本文针对目前法律未对“公共利益”做出明确界定,致使征地范围失控,损害农民利益,引发大量群众集体上访,影响和谐社会建设进程的问题,以自2003年十六届三中全会以来中央数次要求“控制征地规模,改革征地制度”作为切入点,在深入分析当前征地现状的基础上,提出了建立城乡统一的建设用地市场的必要性、可行性及设计思路,为土地使用制度改革提供参考。
