在社会转型期,法院似乎正面临着一个“社会问题司法化”的趋势,主动或被动地介入到各种纠纷解决的前沿,使法院的信任度和权威性再度被削弱。处于矛盾焦点和社会压力之下的法院应当实行职能归位,回归理性,回归常识。在司法价值和内部运作机制的选择与定位上,坚持价值理性,坚持现实主义的态度和技术主义的路径。借鉴现代制度经验,通过科学高效的审判管理模式,减少司法的运行成本,提高司法的公信力,维护宪法和法律的权威。
In the period of social transformation, the court seems to be facing a trend of “judicialization of social issues”, actively or passively entering the frontiers of various dispute resolutions, and the court’s trust and authority are once again weakened. In the focus of conflicts and social pressures, the court should exercise its functions as a homing agent, return to rationality, and return to common sense. In the selection and positioning of judicial value and internal operation mechanism, we should adhere to the value rationality, uphold the attitude of realism and the path of technicalism. Drawing on the experience of the modern system, through scientific and efficient trial management mode, reducing the running costs of justice, enhancing the credibility of the judiciary, and safeguarding the authority of the Constitution and the law.
