The risk society provides a very good opportunity for the innovation of the theories of the criminal law.In the traditional sense, the normative pattern of the criminal law within the "actual damage crime legal centralism" was difficult to get a control on the new types of the social risks.However, the "binary opposition complementary model" should become one of the most ideal models to get a control on the social risks.In addition, it is highly necessary for a great number of the fundamental theories such as the criminal law functions, the concepts of the interests protected by laws, the legislation foundation and forms of the criminal law, as well as the behavioral theory, causal relation theory and the criterion of liability within the criminal law to fulfill the actual needs of the risk society.
