日本的可罚的违法性理论是与司法实务密切关联而发展起来的,尤其与治安体制的联系十分紧密。可罚的违法性理论在六七十年代得到空前发展,是由于这一理论在劳动刑事案件中得到了积极而广泛的运用。然而,在治安体制之下,政府通过对最高法院人事构成的安排,促使判例进行变更并固定下来,导致可罚的违法性理论在司法实务中不再得到运用。我国在借鉴可罚的违法性理论时,应保持必要的谨慎。
Japan’s punishable theory of illegality developed in close connection with judicial practice, especially with the security system is very close. The theory of punishable illegality got an unprecedented development in the sixties and seventies because of the positive and extensive application of this theory in labor criminal cases. However, under the law and order system, through the arrangement of the Supreme People’s Court, the government urges the case to be changed and fixed, so that the theory of punishable illegality is no longer used in judicial practice. When drawing lessons from the theory of punishable illegality, our country should keep the necessary cautiousness.
