三、安全生产违法行为的法律责任安全生产违法行为的法律责任方式有三种:即行政责任、民事责任和刑事责任。在现行有关安全生产的法律、行政法规中《安全生产法》采用的法律责任方式是最全的,设定的处罚种类是最多的,实施处罚的力度(罚款幅度除外)是最大的。 (一) 行政责任它是指责任主体违反安全生产法律规定,由有关人民政府和安全生产监督管理部门、公安机关依法对其实施行政处罚的法律责任。《安全生产法》第九十四条规定:本法规定的行政处罚由负责安全生产监督管理的部门决定,予以关闭的行政处罚由负责安全生产监督管
