军事刑事诉讼程序一直遵循我国刑事诉讼法的规定 ,刑诉法修改后 ,建立在正当程序价值理念之上的审判对抗机制并未在庭审之外作相同比例的延伸 ,依据刑诉法进行的军事侦查程序与审判程序存在着机制冲突 :究竟是改革后的审判程序还是未作改革的侦查程序代表军事刑事程序的价值取向 ?理论上对军事侦查程序正当目的的漠视 ,使现行法律无法回答这一问题。军事侦查程序的正当目的 ,指立法者在正当程序价值理念下设定军事刑事侦查程序规则的应然理想。表现为对军事侦查权的行使科加一定的法律义务、确保被追诉军人享有平等的地位和对等的权利、构建军事司法机关之间的权力制约机制等。
Military criminal procedure has always followed the provisions of China’s Criminal Procedure Law. After the revision of the Criminal Procedure Law, the trial countermeasure mechanism based on the concept of due process value did not extend for the same proportion outside the trial. According to the Criminal Procedure Law There is a mechanism conflict between the investigation procedure and the trial procedure: whether the reform trial procedure or the non-reform investigation procedure represents the value orientation of the military criminal procedure? Theoretically, the disregard of the legitimate purpose of the military investigation procedure makes the current law unable to answer this problem. The legitimate purpose of the military investigation procedure is that law-makers should set the rules of military criminal investigation procedure under the concept of due process value. The performance of the military investigation of the exercise of science and a certain amount of legal obligations to ensure that the soldiers were chastised to enjoy equal status and equal rights and establish a mechanism of power between the military judiciary constraints.
