法学定量研究是实证法学研究与现代计算机科学发展的必然趋势。将这类以具有数量变化关系的法律现象作为研究的出发点,采用统计学、现代数学、人工智能等技术方法对相关数据进行研究,概括为量化或计算法学,不仅有利于增强法律的实用性,缩小裁量差异性,促进司法公平,也有利于法学精细化发展,促进立法科学。量化法学有其产生的必然性,定性和定量应当统一。当然,在人工智能系统中定量已是以非个体的或非以个案作为定量指标了。量化法学中阈值优化决策和改变线性法学思维的理论视角,特别是对《民法典》的制定和在民商法学领域实现人类生活模式多样化的法律理想,具有不可替代的科学意义。
