同居是秦汉时期一个专门的法律术语 ,指共门出入、住在一起的同母兄弟 ,其中含摄着共财的内涵。家族范围内的同居在汉代并不具有普遍的意义 ,因为汉代家族是极少共财的。汉惠帝元年诏 ,“今吏六百石以上父母妻子与同居……家唯给军赋 ,它无有所与”,无疑具有鼓励与父母同居的精神。但笔者认为 ,该诏令之同居是动词用法 ,即共同生活的意思 ,诏令的精神主要是对六百石以上的官吏所给予的经济奖励 ,而条件之一便是与父母同居
