形象权是在形象利益商品化的过程中产生的一种新型权利。但在我国现阶段,形象权仍然是一种应然的法益而非实然的法定权利,因而司法实践中通常采用包括人格权法、著作权法、商标权法和反不正当竞争法在内的综合手段保护形象权。而传统的人格权法等对其保护显示出其无能为力的一面,无论放到人身权领域还是单放到版权领域解决,都难以得出令人满意的答案。本文将从形象权的定义、内容、性质及保护等方面对形象权的保护进行了分析探讨。
