“夫妻黄碟案”暴露出来的问题值得我们认真思考。从宪政角度出发,对宪法所规定的公民基本权利保障是宪法精神的终结所在,也是宪政的核心价值。而公民基本权利中最重要的是涉及保障公民人身自由、生命安全的权利,即公民在司法尤其是刑事司法程序中的基本权利。我国应当加强和完善公民基本权利尤其是刑事司法程序权利的宪法化保护。 “Couple yellow dish case ” exposed the issue deserves our serious consideration.
