随着对外开放的发展,自1987年在我国发生的首宗“海利轮诉温州港务监督”的涉外行政诉讼案件以来,各类涉外行政诉讼案正呈日益增多的趋势。《中华人民共和国行政诉讼法》(以下简称《行政诉讼法》,虽然对外国人、无国籍人和外国组织在我国进行行政诉讼的问题作了专章规定,但这些规定只是原则性的规定,是不能满足和适应现实状况和未来发展要求的。本文试就外国人、无国籍人和外国组织作为行政诉讼参加人及其行政诉讼权利和义务的问题加以探讨。一、行政诉讼外方诉讼参加人

However, these provisions are only the principle provisions, Is unable to meet and adapt to the reality and the future development requirements.This paper attempts to explore the issue of foreigners, stateless persons and foreign organizations as participants in administrative proceedings and their rights and obligations of administrative litigation. people
