根据《中华人民共和国港口法》(以下简称《港口法》)第六条和第十三条的有关规定,特制定《港口深水岸线标准》,现予公布。使用港口岸线,实行两级审批制度。由国务院或国家发展和改革委员会审批的港口设施或建设项目,不再单独办理使用港口深水岸线的审批手续。其余港口设施或建设项目使用港口深水岸线的,由各城市(设区的市,下同)港口管理机构征求同级人民政府有关部门和海事部门意见后,向省、自治区、直辖市交通厅、交通委员会或港口管理局提出申请(附必要的项目可行性研究报告和文件、资料,下同);各省、自治区、直辖市交通厅、交通委员会或港口管理局应对使用港口深水岸线的合理性进行评估,并征求同级发展和改革委员会(计委)的意见后,向我部提出使用港口深水岸线申请;我部在进行评估后,会同国家发展和改革委员会审批。
