随着生物技术的发展,人们的生活也随着日新月异的科学技术慢慢地发生着变化。其中被称为“第二次绿色革命”的转基因技术是20世纪生物技术的重要成果,它在很大程度上解决了由于人口激增而产生的粮食危机以及能源匮乏等问题。目前转基因技术已经在世界各国得到了广泛的应用并且这种趋势不可避免。但是由于发展时间还短,发展成果不确定,转基因食品的安全性还没有得到完全的证实,并日渐成为食品安全领域的新论题。世界各国立足于本国国情考虑到一系列的潜在风险,都采取了相应的措施对转基因食品进行了有效地监管。总的看来,大致分为两派:以美国为代表的宽松派;以欧盟为代表的严格派。我国虽然在转基因技术方面已经达到了世界先进水平,但是在转基因食品方面的监管实践方面却远不如转基因技术的发展。因此,本文认为对转基因食品的法律规制迫在眉睫,如何在保证转基因食品的安全性的同时,利用好转基因食品的巨大潜力,已经成为法律工作者不断探索的理论和实践难题。
With the development of biotechnology, people’s lives are gradually changing with the ever-changing science and technology. Among them, the “green revolution” technology called “The Second Green Revolution” is an important achievement of biotechnology in the 20th century. It largely solved the food crisis caused by the surging population and lack of energy. At present, transgenic technology has been widely used in all countries in the world and this trend is inevitable. However, due to the short development period and the undeveloped development achievements, the safety of genetically modified foods has not yet been fully confirmed and has gradually become a new topic in the field of food safety. All countries in the world have taken corresponding measures to take effective measures to regulate genetically modified foods, taking into account a series of potential risks based on their national conditions. In general, there are broadly divided into two groups: the liberal school represented by the United States; the strict school represented by the EU. Although China has reached the world advanced level in genetically modified technology, regulatory practice in genetically modified foods is far less advanced than that in transgenic technology. Therefore, this paper argues that the legal regulation of genetically modified food is imminent. How to utilize the great potential of genetically modified food while ensuring the safety of genetically modified food has become a theoretical and practical problem for legal workers.
