女子财产继承权是近代法律变革的重要内容,它打破了财产继承以男性为中心的传统。此次法律变革开辟了男女平等的新时代,对封建性别歧视予以严重抨击。尽管法律赋予女子继承遗产的权利,但这并非是行为能力。此次法律变革实质上有利也有弊,变革的原因在于统治者的政治目的,并不是社会自然发展的结果,这对于我们进行现代化法治建设具有重要意义。
The inheritance of women’s property is an important part of the modern law reform. It breaks the tradition of inheritance of property with men as the center. This legal change has opened up a new era of equality between men and women and severely attacked feudal gender discrimination. Although the law gives women the right to inherit the property, it is not a matter of ability. The legal change is actually beneficial and have a disadvantage. The reason for the change is that the political purpose of the ruler is not the result of the natural development of society. This is of great significance for us to carry out the modernization of the rule of law.
