目前,全国各地公证处的公证收费参照的仍然是《公证暂行条例》时代由国家发展计划委员会、司法部于1997年下发的《公证服务收费管理办法》(计价费[1997]285号)和1998年下发的《关于调整公证服务收费标准的通知》(计价费[1998]814号)。经过了十五年时间社会发展,很明显,该收费标准已经无法满足于现实情况的需求。与此同时,各地人大、政府甚至是公证处早已在很多公证事项中或明或暗地突破着该收费标准的限定。2006年颁布实施的《公证法》的第46条明确规
