近几年来,随着我国改革的深化和对外开放的发展,外国企业按照合同的约定来华承包或租赁经营企业(包括内资企业和外商投资企业)的情况越来越多。承包或租赁经营的方式,一般由境内企业作为发包方或出租方,向承包方提供营业执照和营业场所的使用权,承包方或租赁不论盈亏定期向发包方或出租方支付承包费(包括“利润”)或租赁费,作为承包(租)经营企业的费用列支。承包(租)方承包(租)经营企业后,发包方或出租方不干预企业的经营管理,对企业的盈亏和债权债务也不负任何责任。
