刑事诉讼的证明对象,是指案件中依法运用证据予以证明的事实情况。在刑事诉讼中,凡是同追究被告人刑事责任有关的一切需要查明的事实,都是证明对象。它具体包括三类即实体法事实、程序法事实和证据事实。 实体法事实是指对被告人定罪量刑具有法律意义的事实。我们知道,诉讼法是为了从程序上保证实体法的实施,诉讼中所要查明的案件事实,则主要应由实体法所规定,公安、司法人员的任务,就在于根据实体法的规定运用证据来查明条件事实。刑事诉讼中的条件事实主要由刑法规范规定,它包括两部分内容:一是有关犯罪的事实,其中主要是有关犯罪构成要件的事实,这是证明对象的主要部分和核心内容,是刑事诉讼的基本证明对象,我国刑事诉讼法第三十二条规定:“审判人员、检察人员、侦查人员必须依照法定程序收集能够证实被告人有罪或者无罪、犯罪情节轻重的各种证据。”这一条文所指的“被告人有罪或者无罪、犯罪情节轻重”即是案件的基本证明对象。在刑事诉讼中,要确定某一行为是否构成犯罪、构成何罪,即要衡量其是否符合某一犯罪构成要件,这就要求我们用相应的证据予以证明。
