《中华人民共和国行政诉讼法》第50条明确规定:“人民法院审理行政案件,不适用调解。”基于这一法律规定,人民法院审理行政争议案件除了行政赔偿诉讼案件可以适用调解外,其他行政诉讼案件不适用调解。但在司法实践中并非如此,很多法院在审理行政诉讼案件时,都采取调解的手段促成原告撤诉或被告改变具体行政行为,有效降低了行政案件的信访投诉率,维护了社会稳定、和谐。但是由于调解制度在立法上的缺陷,不可避免地出现有违行政审判立法精神等问题,本文主要通过对诉讼调解理论的分析,提出我国行政诉讼中引入调解制度的构想。
Article 50 of the Administrative Procedure Law of the People’s Republic of China clearly stipulates: “People’s courts handle administrative cases and are not applicable to mediation.” Based on this law, people’s courts in administrative adjudication cases may apply mediation in addition to administrative compensation lawsuits, Other administrative proceedings do not apply mediation. However, this is not the case in judicial practice. Many courts, in their handling of administrative litigation cases, resort to mediation to induce plaintiffs to withdraw or defend to change their specific administrative behaviors, effectively reducing the petition complaint rates in administrative cases and safeguarding social stability and harmony. However, due to the defects of the mediation system in the legislation, it inevitably leads to the violation of the legislative spirit of the administrative trial and other issues. This paper mainly puts forward the conception of introducing the mediation system into administrative litigation in our country through the analysis of the theory of litigation mediation.
