随着社会的发展,在我国近些年里社会募捐等活动逐渐增多,因其发展势头旺盛也因此存在一定的问题和隐患,目前我国对于募捐活动的管理和规定还缺少系统的全面性要求,缺乏严谨的指导理论,在募捐活动出现相关问题时司法机关无法根据规定对其做出正确的判断和处理工作。本文对相关人士和学者对社会募捐出现的问题进行了一系列的总结和梳理,对募捐行为的初衷及后续的发展从法律的方面进行深入的总结分析,协助法律对募捐行为的监督和管理。
With the development of society, the activities such as fundraising in our society have been gradually increasing in recent years. Due to the strong development momentum, there are some problems and hidden dangers. At present, the management and regulation of fund-raising activities in our country still lacks systematic and comprehensive requirements, Lack of rigorous guidance theory, the fund-raising activities in the relevant issues, the judiciary can not be made under the provisions of the right to judge and handle it. This article carries out a series of summarization and combing of the problems of social fund-raising by relevant persons and scholars, and analyzes and summarizes the original intention and subsequent development of fund-raising behavior from the aspect of law so as to assist the supervision and management of fund-raising behavior by law.
