非法证据排除规则的确立及内容构成,关系到实体真实与程序正当、控制犯罪与保障人权之间的价值选择和国家公权力与公民私权利之间的利益冲突的权衡以及刑事诉讼价值和目的的实现。对非法证据排除规则的理论基础及价值导向的研究,对进一步深入研究非法证据排除具有重要的意义,对我国的诉讼理论、立法与司法实务也具有十分重要的意义。
The establishment of the exclusionary rules of illegal evidence and the constitution of the contents are related to the balance between the true choice of the entity and the procedure, the choice of value between the crime control and the protection of human rights, the conflict of interests between the state public power and the civil and private rights, and the value and purpose of the criminal procedure achieve. The research on the theoretical basis and value orientation of the rule of exclusion of illegal evidence is of great significance to the further study of the exclusion of illegal evidence. It is also of great significance to China’s litigation theory, legislation and judicial practice.
