本文从产权理论视角来考察雇员隐私保护在互联网时代面临的种种困局。笔者的分析表明,一味地“加强立法”来完善国家层面对公民隐私保护的立法路径并不能从根本上解决当前雇员隐私困局。因为“加强立法”并不能在真实世界中实现清晰界定产权的社会效果,“加强立法”也未能促成以福利最大化为指向的科斯谈判得以顺利展开。在互联网时代,由于较高昂的产权界定成本的存在,隐私产权在真实世界中处于有待“二次分配”的状态。为破解雇员隐私保护困局,国家需要在科学认识互联网时代雇员隐私之特殊品格的基础上,充分尊重劳资双方的实践智慧,通过鼓励、识别和确认微观层面的有关雇员产权的“二次分配”的新方式、新方法,来实现对雇员隐私保护的优化。
This paper examines the various difficulties that employee privacy protection faces in the Internet age from the perspective of property rights theory. The author’s analysis shows that blindly “strengthening legislation” to improve the national level of privacy protection for citizens of the legislative path can not fundamentally solve the current employee privacy dilemma. Because “Enhancing Legislation ” can not realize the social effect of clearly defining property rights in the real world, “strengthening the legislation ” also failed to promote the Kosovo negotiation smoothly proceeding with the maximization of welfare. In the Internet era, due to the higher cost of defining the existence of property rights, private property rights in the real world in the “secondary distribution ” state. In order to solve the dilemma of employee privacy protection, the state needs to fully respect the practical wisdom of both employers and employees on the basis of scientifically understanding the special character of employees ’privacy in the Internet era and encourage the recognition and confirmation of the “secondary distribution of employees’ rights at the micro level ”New ways, new methods to achieve the optimization of employee privacy protection.
