我国在第三次《著作权法》的修订过程中计划移植源自北欧的著作权延伸性集体管理制度,意在更好地保护非会员著作权人和提高作品的利用效率。综合考虑相关的立法设计、延伸性集体管理的社会基础以及我国著作权集体管理组织的发展现状,可以判断移植延伸性集体管理制度不仅无法实现预期目标,反而可能会损害预期目的。
In the process of revising the Third Copyright Law, China plans to transplant the collective copyright management system of copyright originating in Northern Europe. It aims to better protect non-member copyright owners and improve the utilization efficiency of their works. Considering the related legislative design, the social foundation of extension collective management and the status quo of the collective management organization of copyright in our country, we can judge that the system of extended collective management of transplantation not only fails to achieve the expected goal, but may undermine the expected purpose.
