对谈属于微观社会学范畴。一般意义上讲,对谈是人与人之间的话语互动过程和现象。在司法上,调解过程的对谈极为普遍,因而往往被视为惯常的现象。法治原则之下的行政过程应当是一个对谈的过程,而且实定法业已确立了“告知—听取”模式的正式规则,但当下行政主体由于受传统行政观念的影响,不仅缺乏对正式规则的耐性,更少有对非正式规则的遵循。行政过程中对谈的缺失,严重阻滞了政府服务力的有效实现,且有悖于服务行政的基本要求。因此,倡导行政主体接纳对谈的观念,践行对谈的基本规则,不仅能有效地提高政府服务力,而且会支持行政法治的顺利达成。
The dialogue belongs to the category of micro-sociology. In a general sense, dialogue is a process and phenomenon of discourse interaction between people. In the judiciary, the conciliation process is extremely common and is often regarded as a habitual one. The administrative process under the rule of law should be a process of dialogues and the formal law industry has established the formal rules of “inform-listen ” mode. However, due to the influence of the traditional administrative concept, the current administrative body not only lacks of the formal rules More patience, and less adherence to informal rules. The absence of dialogues in the administrative process has seriously hindered the effective realization of government service capabilities and runs counter to the basic requirements of service administration. Therefore, to advocate the concept that the administrative body admits the dialogues and implement the basic rules of the dialogues can not only effectively improve the government service force, but also support the smooth implementation of the administrative law.
