反规避(Anti-Circumvention)是反倾销领域的一个重要制度。反规避措施针对的是一切形式的规避行为,它旨在打击实际目的在于削弱或者完全规避反倾销措施效果的行为。但是,难点在于,如何能够在确保反倾销措施的实际有效性的同时,又能保证不对处于反倾销措施制裁的来源国的生产商就企业内部事项做出决定的自主权造成不当干涉和侵犯?本文在分析欧洲共同体反规避措施的基础上,试图找出解决此问题的关键所在。
Anti-Circumvention is an important system in anti-dumping. Anti-circumvention measures are all forms of evasion and are aimed at cracking down acts whose actual purpose is to weaken or completely evade the effects of anti-dumping measures. However, the difficult point is that how to ensure that the anti-dumping measures are actually effective, but at the same time ensure that the manufacturers in the countries where the anti-dumping measures are imposed will not interfere with or interfere with the autonomy of manufacturers in making decisions on internal matters? On the basis of an analysis of the European Community’s anti-circumvention measures, it is trying to find the key to solving this problem.
