大学生村官工作就其性质而言,不是计划也不是制度,而是党和国家的一项政策性安排。大学生村官的法律身份是县级组织人事部门聘用、委托乡镇政府代为管理并委派到农村工作的合同制工作人员,大学生村官与县级组织人事部门存在劳动关系。在大学生村官融入农村的过程中,法律应有所作为,应不断完善大学生村官发展的政策法律依据,明确其法律身份,并为其发展提供法律保障。
The work of university student village officers, by their very nature, is neither a plan nor a system, but a policy arrangement by the party and the state. The legal identity of the village official is a contractual staff employed by the county-level departmental personnel department and entrusted by the township government to manage and assign them to rural work. The village official has a labor relationship with the county-level departmental personnel department.
