正当防卫是法律赋予公民同违法犯罪行为作斗争的一种重要权利和手段,其目的是鼓励公民与正在进行的不法侵害作斗争,保障社会公共利益及公民的合法权利免受正在进行的不法侵害。从我国的正当防卫的立法规定来看,为学界提供了很大的解释空间,从而也就出现了各种不同的观点。但本文认为现存的诸多解释有一种不当的价值倾向,对防卫人的防卫权利的过分扩张,文中对我国正当防卫制度的立法价值进行了简要的探讨。
Legitimate defense is an important right and means that the law confers on civilians to fight criminal acts. Its purpose is to encourage citizens to fight against ongoing unlawful violations and protect the public interests and the legitimate rights of citizens against ongoing violations of law and order . Judging from the legislative provisions of our country’s justifiable defense, there is a lot of room for explanation for the academic circles, and different views have emerged. However, this article argues that many extant explanations have an improper value tendency and overly expanded the defensive rights of the defender, and the article briefly discusses the legislative value of China’s justifiable defense system.
