中国正面临着全方位整体性变革,尤其是全社会“良治”与“善治”的吁求正在转化成为(天下)治理现代化的全面行动,也即传统秦汉以降的帝国理念与家国情怀开始向现代民族国家建构理想全面转型。尽管根据中国传统以及历史和现实情势,我们很难采用康德-罗尔斯的理性人预设以建构中国的整体性秩序,也无法直接采用休谟-哈耶克理路的人性预设以重建正义规则论,但是不能据此以为传统秦汉政制以及孔孟之道仍能建构出现代中国的主体性乃至中国道德的根基。我们显然必须对包括出自中国传统在内的正义渊源重新做出审慎的思考,并在现当代条件下进行必要的创造性转换。道德哲学的重构,便成为重中之重。
