我国未成年犯轻罪前科免除报告制度已经载入刑法,同时新修订的刑诉法也确立了未成年人轻罪犯罪记录封存制度。这是我国民主法治建设的重大进步,但我们也必须认识到不论是轻罪前科免除报告制度,还是轻罪犯罪记录封存制度,均不意味着未成年犯的轻罪犯罪记录消灭,因此要加强对新形势下我国未成年人轻罪犯罪记录消灭制度的研究,加快构建未成年人轻罪犯罪记录消灭制度。
China’s juvenile misdemeanor criminal record exemption reporting system has been included in the criminal law, while the newly revised Criminal Procedure Law also established juvenile misdemeanor criminal record storage system. This is a significant progress in the construction of democracy and the rule of law in our country. However, we must also recognize that no matter whether the system of excused misdemeanors or the misdemeanor criminal record-keeping system do not mean that juvenile delinquency crimes have not been eliminated, Under the new situation, the study on the system of eliminating minor criminals’ crimes in our country will be accelerated, and the system of eliminating criminal records of juvenile delinquency will be speeded up.
