【裁判要旨】人体摄影著作权人未经人体模特授权擅自使用其享有著作权的作品用于商业出版发行,应承担侵犯被摄影人肖像权的责任:出版社未尽相关审查义务的,承担连带责任。
【Purposes of Judgment】 Human body photography copyright owners who use their copyrighted works for commercial publication and distribution without human body model authorization shall bear the responsibility of infringing the portrait rights of the photographer: If the publishing house fails to fulfill relevant examination obligations, it shall be jointly and severally liable.
