检察机关作为我国死刑执行临场监督的唯一监督机关,在实践中经常会出现监督不力的情况,导致执行过程中出现了一些不尽人道、不尽合理的现象。本文认为律师应当参与死刑立即执行的临场监督,这既有利于保障死刑犯的合法权益,使死刑犯家属的心理得到慰藉,又能让死刑的执行更加透明,增强公众对司法的信赖度,对我国死刑执行监督制度的完善具有非常重要的意义。
As the only supervisory organ in our country where the death penalty is executed on-the-spot supervision, procuratorial organs often experience ineffective supervision in practice, resulting in some incomplete and unreasonable phenomena in the implementation process. This article argues that lawyers should be involved in the immediate supervision of execution of death penalty, which not only helps to protect the legitimate rights and interests of the death penalty prisoners, but also makes the execution of the death penalty more transparent and enhance the public trust in the judiciary. The perfection of our country’s execution of execution of death penalty is of great significance.
