治安管理处罚是社会治安综合治理工作的重要工作内容,其中,治安管理处罚中的取缔是具有法律效力的行政措施,《治安管理处罚法》明确说明治安管理处罚中的取缔具有非制裁性、非处分性、附属性和综合性的特点。在我国现阶段,由于缺乏对治安管理取缔性质的一致认识,在实际的具体工作开展中,取缔的实施往往由于缺少统一的管理和规范,因而在工作中出现了许多的问题,甚至出现了一些侵害民众权利的现象。因此,为了更加合法规范地在社会综合治安综合治理工作中进行治安管理处罚的具体工作,本文从取缔的概念及其内涵出发,分析了取缔的法律性质和取缔行为的特点,并结合实际情况和相关法律,提出了加强取缔在治安管理处罚工作中的具体适用对策。
