现行的民事执行监督体系并不完善,“执行难、执行乱”已经成为民事执行工作中的重大问题,不仅容易滋生司法腐败,而且损害了司法的公正与权威。检察机关作为国家法律监督机关,在民事执行监督中起着不可或缺的作用。需要通过立法形式明确民事执行属于检察监督的范围,并赋予检察机关相应的监督方式与手段,构建行之有效的保障机制,以确保民事执行检察监督的效力。
The current system of civil enforcement supervision is not perfect, and “implementation is difficult and execution is chaotic” has become a major issue in civil execution. It not only breeds judicial corruption but also undermines the justice and authority of the judiciary. As a supervisory organ of state law, procuratorial organs play an indispensable role in the supervision of civil execution. It is necessary to clarify the scope of procuratorial supervision by means of legislation and to provide procuratorial organs with appropriate supervision methods and means so as to establish an effective guarantee mechanism so as to ensure the effectiveness of civil execution of procuratorial supervision.
