由行政系统主导的合作治理已经成为当代行政法治的基本方式之一。由于行政合作治理是一种多主体的治理,如何在治理过程中不偏离原来的目标,尤其是如何在治理过程中维护公共利益,是相关主体不得不面对的问题。我国的合作治理尚处于起步阶段,理论和实践对合作治理中的利益关系尚未进行系统研究和有效应对,更谈不上量化分析,使得合作治理存在着阻碍或者侵害公共利益的风险。为此,应当对合作治理中的公共利益作出法律上的界定;构造合作治理中公共利益的体系;确立公共利益维护的方式;设定公共利益维护的程序规则。
The cooperative governance dominated by the administrative system has become one of the basic ways of the administrative law. Because administrative cooperative governance is a kind of multi-subject governance, how to keep the public interest in the process of governance is a problem that the related subject has to face in the process of governance. China’s cooperative governance is still in its infancy. Theory and practice have not systematically studied and effectively deal with the interest relations in cooperative governance, let alone quantified the analysis, making cooperative governance a risk that hinders or infringes upon the public interest. To this end, we should make a legal definition of the public interest in cooperative governance; construct a system of public interest in cooperative governance; establish the means of safeguarding the public interest; and set rules of procedure for the maintenance of public interest.
