作为西方社会长期发展的产物,民主和宪政都被寄寓了人类对幸福的憧憬和期望,但各自又蕴涵着特有的价值理念和人文关怀。相对于个人权利和自由而言,民主与宪政都只是手段,个人权利和自由才是目的。在制度层面,要建立健全民主党政体制,应重塑“民主”与“宪政”的协调并用模式,扬弃单纯的民主和单纯的宪政的弊端。
As a product of the long-term development of the western society, democracy and constitutional government are all embracing the hopes and expectations of mankind for happiness, but each contains unique values and humanistic concern. As opposed to individual rights and freedoms, democracy and constitutional government are all instruments, and individual rights and freedoms are the ends. At the institutional level, to establish and perfect the system of the democratic political system, it is necessary to reshape the coordination and combination of “democracy” and “constitutionalism” and discard the shortcomings of simple democracy and simple constitutional government.
