“法学教育目标”问题在法学教育领域一直备受争议。作为基础性问题它不仅影响法学教育改革的走向,甚至决定法学教育改革的成败。但是当下法学教育改革的话题绝大多数是在法学家的关注与推动下展开的,关于“法学教育目标问题”的研讨,普遍存在教育学属性研究的缺位问题。法学教育学的学科属性决定了对法学教育目标问题的研究不应脱离对教育学中教育目标论的相关研究。大学阶段法学教育的目标设定应扭转过分强调素质教育的现状,在坚持素质教育为主要导向的前提下,向职业教育适度倾斜。
The issue of “the goal of legal education” has been disputed in the field of law education. As a basic problem, it not only affects the trend of legal education reform, but also determines the success of legal education reform. However, most of the topics of law education reform nowadays are under the concern and promotion of jurists. There is a general discussion on the issue of “the goal of legal education” and the absence of the study of pedagogical properties. The disciplinary attribute of law pedagogy determines that the research on the goal of legal education should not be divorced from the related research on pedagogical goal theory. The goal setting of law education in college should be to reverse the emphasis on the status quo of quality education, and should be moderated to vocational education on the premise of maintaining quality education.
