劳动合同是劳动者与用人单位之间明确双方权利义务、确立劳动关系的法律凭证;民事合同是确立当事人之间民事权利义务的协议。劳动合同与民事合同是两种不同性质的合同,主体不同、内容不同、订立方式不同、解决纠纷方式不同等等,两种合同适用不同的法律规范,法律对当事人的保护范围也有很大区别。因此,正确划分合同类型,对不同类型合同当事人合法权益的保护,具有非常重要的现实意义。
The labor contract is a legal document that clearly defines the rights and obligations of both parties and establishes the labor relationship between the laborer and the employer. The civil contract is an agreement that establishes the civil rights and obligations between the parties. Labor contracts and civil contracts are two different types of contracts, with different subjects, different contents, different ways of setting up and different ways of settling disputes. Different kinds of legal norms apply to the two contracts, and the law also makes a big difference in the scope of the parties’ protection. Therefore, the correct division of contract types, the protection of the legitimate rights and interests of different types of parties to the contract, has very important practical significance.
