近代以来,在法律现代化过程中产生的大量的法律冲突、法律规避,其中一个极为重要的原因便是对西方法律的盲从和对法律移植的盲信,而其根本原因在于由我国社会文化自身特点决定的,能够在中国运行得良好的法律,必然是能够为我国社会文化所容纳的法律.当我们认识到这些问题,重新检讨历史就成为必要;当我们认识到法律移植并不能从根本上解决法律现代化的问题,就必须寻找新的路径。法律继承将是一个极为便利亦更加有效的途径。因此,中国法律能够在继承上走得更远一些.
