海上运输中难免会发生船舶碰撞。为了对各国船舶碰撞的法律规定加以统一,1910年9月23日在布鲁塞尔举行的第三届海洋法会议上签订了“统一船舶碰撞若干法律规定的国际公约”(以下简称“碰撞公约”)。公约于1913年3月1日起生效。目前批准或加入该公约的共有84个国家和地区。可是,美国不是公约的缔约国,而且至今还没有加入该公约。所以在船舶碰撞方面,美国的法律规定和“碰撞公约”的规定有许多方面不相一致,值得我们认真研究。
Ship collision will inevitably occur in maritime transport. In order to harmonize the legal provisions on ship collisions in various countries, the Third International Conference on the Law of the Sea, held on September 23, 1910 in Brussels, signed the International Convention on the Unification of Certain Laws Concerning Ships’ Collisions (hereinafter referred to as the “Convention on Collisions”). The Convention entered into force on March 1, 1913. There are currently 84 countries that have ratified or acceded to the Convention. However, the United States is not a party to the Convention and has not acceded to it so far. Therefore, in the collision of ships, there are many inconsistencies between the legal provisions of the United States and the provisions of the “Convention on Collision” and it deserves our careful study.
