犹太教免于自证其罪的规定最早出现在犹太教塔木德经中,在宗教背景下,这一规定在特定的历史时期对犹太教和犹太民族之生存发展起到了重要的作用。免于强迫自证其罪特权这一与犹太教免于自证其罪规定有相似之处的法律特权已经为大多数国家和地区所确立,由于产生的时间、背景不同,二者在价值与作用方面存在着较为明显的区别,但是在人权保障与逻辑发展方面二者之间也存在着密切的联系。对犹太教免于自证其罪规定的研究依然有其现实意义,通过与免于强迫自证其罪特权之比较,探寻免于自证其罪规定符合现在法律发展要求的内在价值。
Judaism exempted from the crime of self-incrimination first appeared in the Talmud of Judaism. In the religious context, this provision played an important role in the survival and development of Judaism and Jewish people in a particular historical period. Freedom from compelling self-incriminating privilege, a legal privilege that is similar to Judaism’s exemption from self-inculpation, has been established in most countries and regions. Due to the different time and different backgrounds, However, there is a close link between the two in terms of the protection of human rights and the development of logic. The study on Judaism exempting self-incrimination still has its realistic significance. By comparing with the privilege of forcing self-incrimination, Juridicalism explores the intrinsic value of the regulation of freedom from self-incrimination in line with the current legal development requirements.
