劳动关系是十分重要的社会关系,为维护劳动关系的和谐稳定,我国针对这一问题做了众多的制度设计,《劳动合同法》的出台,在维护职业稳定、保护劳动者权益方面赋予了重要的地位,但是在综合国际劳动关系发展的新趋势来看,劳动关系上升到了劳资合作的新层次,即要兼顾劳动者和用人单位的共同利益,故在劳动合同的订立和解读上,要注意不能单方面适用对劳动者有利的解读方式,要综合合同的订立时的真实意思表示来进行解读。
Labor relations are very important social relations. In order to maintain the harmonious and stable labor relations, China has done many system designs for this issue. The promulgation of the “Labor Contract Law” has given prominence to safeguarding occupational stability and protecting the rights and interests of workers However, judging from the new trends in the development of international labor relations, the labor relations have risen to a new level of labor-capital cooperation. In other words, we must take into consideration the common interests of laborers and employers, so we should pay attention to the establishment and interpretation of labor contracts We should not unilaterally apply the mode of interpretation favorable to workers, and interpret it in the light of the true meaning of the contract at the time of conclusion.
