醉酒驾驶产生的交通事故造成的损失,保险人是否应当对此承担交强险的赔偿责任?交强险的社会公益性更倾向于受害人的权利保障与《机动车交通事故责任强制保险条例》第二十二条又给予保险人以免责之间的矛盾使得各地方法院所作出的判决也大相径庭,在司法实践中造成一定的混乱局面。本文结合现实案例,着重谈一下对这一问题的看法。
