当前,我国关于商业秘密的保护原则、保护范围和侵犯主体不明确、尚没有统一的商业秘密法以及统一的商业秘密评估标准与机构等存在缺陷。应通过制定专门的商业秘密保护法,从而确定商业秘密法律保护原则、侵犯的主体和保护范围、明确有关国家机关人员的保密责任、加重被告的举证责任,建立国际标准化的商业秘密评估机构来与国际接轨等措施解决上述问题。
At present, China’s commercial secrets protection principles, the scope of protection and violations of the main is not clear, there is no uniform commercial secrets law and a unified commercial secret evaluation standards and institutions, and other flaws.
